Buying a Holiday Home in Jamaica: What Visitors Should Sort Out First

Buying a Holiday Home in Jamaica: What Visitors Should Sort Out First

Plenty of visitors leave Negril, Ocho Rios or Treasure Beach thinking about buying their own place. It's doable, since Jamaica generally allows foreigners to own property, but a few checks up front save a lot of trouble later.

1. Check the title before you fall in love

Most land in Jamaica is registered with the National Land Agency, identified by Volume and Folio. Some family land is unregistered, and that is a red flag for a buyer. Ask for the title details and run an independent title search to confirm who owns it and whether there are mortgages, caveats or restrictive covenants.

2. Hire your own attorney

In Jamaica, sales normally go through attorneys-at-law. Use one who represents only you. They handle the sale agreement, stamp duty and transfer tax, and registration of the transfer.

3. Budget beyond the price

4. Renting it out

If you plan to rent to visitors, ask about TPDCo registration and tax on rental income. Location matters. See our guides to Negril, Montego Bay and villas vs all-inclusives to see what guests want.

5. Plan who inherits it

This step gets forgotten. If you die owning Jamaican land, your heirs need a Jamaican grant to transfer it. A will from your home country can work, but it often means extra court steps in Jamaica. A US grant, for example, generally can't simply be resealed. A short Jamaica-only will that names a Jamaica-friendly executor and describes the property by Volume and Folio keeps things simple. It should say it covers only Jamaican property so it doesn't revoke your will at home.

You can create one with HowJamaica's Jamaican Will Wizard: guided questions, a print-ready PDF and a signing checklist for two witnesses, wherever you live (US$49.99, self-service template, not legal advice). For larger estates, ask your attorney to coordinate it with your home-country will.

FAQ

Can foreigners buy property in Jamaica?

Yes. Jamaica generally allows non-citizens to buy land and homes. You will need an attorney, a TRN and funds that can be traced for anti-money-laundering checks.

Should I make a Jamaican will if I buy a villa?

Usually yes. A Jamaica-only will lets your executor deal with the property in Jamaica without first finishing probate in your home country.

Can I rent my Jamaican holiday home to tourists?

Many owners do. Check registration requirements with the Tourism Product Development Company (TPDCo) and declare rental income for tax.
